1. Acceptance of Terms
By accessing or using Amanah Invest, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and Account Registration
You represent that you are legally able to enter into this agreement and will provide accurate information. You are responsible for safeguarding your credentials and for all activity under your account.
3. Service Description and No Personalized Advice
Amanah Invest provides data tools, screening workflows, educational content, and portfolio utilities. Content is provided for informational purposes and does not constitute personalized investment, legal, tax, accounting, or religious advice.
4. Permitted Use
You may use the Service only for lawful internal purposes and in accordance with these Terms. You agree not to misuse APIs, automate abusive scraping, interfere with system integrity, or attempt unauthorized access.
5. Prohibited Conduct
You must not: (a) violate applicable law; (b) infringe third-party rights; (c) distribute malware; (d) reverse engineer restricted service components except where law prohibits this restriction; or (e) use the Service to generate deceptive, unlawful, or harmful activity.
6. Subscriptions, Billing, and Auto-Renewal
Certain features require a paid subscription. Pricing, billing interval, and included features are shown at checkout. Unless stated otherwise, subscriptions renew automatically at the end of each billing cycle until canceled.
7. Payment Processing
Payments are handled by third-party processors. You authorize us and our processor to charge your selected payment method for recurring fees, applicable taxes, and any unpaid balances under these Terms.
8. Cancellation and Refunds
You can cancel renewal at any time from account settings or by contacting support. Cancellation stops future renewals and does not automatically reverse charges for elapsed or partially used periods unless required by law or a posted offer. Refund requests are reviewed in good faith using plan type, usage, timing, legal requirements, and anti-fraud checks. Approved refunds may be full or prorated as permitted by law and payment-network rules.
9. Chargebacks and Failed Payments
If a payment fails or a chargeback is initiated, we may suspend paid features while the balance is unresolved. You remain responsible for valid charges and any recoverable costs allowed by law and processor rules.
10. Third-Party Data and Service Dependencies
Some features depend on third-party data providers and integrations. We do not guarantee uninterrupted availability, perfect accuracy, or continuous access to third-party content.
11. Intellectual Property
The Service, including software, data arrangement, design, trademarks, and documentation, is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
12. User Content and Feedback
You retain rights to content you submit, but you grant Amanah Invest a license to host, process, and display that content as needed to operate and improve the Service. Feedback may be used without restriction to improve products and operations.
13. Service Availability and Changes
We may modify, suspend, or discontinue parts of the Service, including features, limits, and pricing. We will provide notice where required by law.
14. Disclaimers
To the maximum extent permitted by law, the Service is provided on an AS IS and AS AVAILABLE basis. We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the extent permitted by law, Amanah Invest and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption. Aggregate liability is limited to the greater of amounts paid by you in the 12 months before the claim arose or USD $100.
16. Indemnification
You agree to indemnify and hold harmless Amanah Invest, its officers, employees, and agents from claims arising out of your misuse of the Service, violation of these Terms, or infringement of third-party rights.
17. Suspension and Termination
We may suspend or terminate access for legal risk, non-payment, abuse, security threats, or material breach. You may stop using the Service at any time. Provisions that should survive termination will survive.
18. Governing Law and Disputes
Unless mandatory law requires otherwise, these Terms are governed by the laws of the State of New York, excluding conflict-of-law rules. Venue for disputes is in competent courts located in New York, New York. Nothing in this section limits rights that cannot be waived under applicable consumer law.
19. Export Controls and Sanctions
You may not use the Service in violation of export control or sanctions laws. You represent that you are not a prohibited party under applicable trade restrictions.
20. Changes to Terms
We may update these Terms. Material updates will be notified through the Service or by email where appropriate. Continued use after the effective date constitutes acceptance of revised Terms, subject to mandatory law.
